THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 21695 OF 2021 ORDER:-
The present Writ Petition is filed questioning the action of the Respondents No. 3 and 4 in trying to interfere with possession and enjoyment of the Petitioners and trying to dispossess them from the land to an extent of Ac.7.13 cents (Petitioner No.1); Ac. 7.11 cents (Petitioner No.2) and Ac. 7.11 cents (Petitioner No.3) situated in Sy.No.58 of Budidapadu Village Lands, Chapadu Mandal, Kadapa District as illegal and arbitrary. 2. Heard Mr. G. Ramesh Babu, learned counsel for the Petitioners and Mr. V. Farooq, learned Assistant Government Pleader, Home for the Respondents. 3. Learned counsel for the Petitioners would submit that the Respondent/ Police frequently calling the Petitioners to the Police Station at the behest of the Respondent No.5. 4. Learned Assistant Government Pleader for Home, on instructions, would submit that this Court granted interim order dated 29.09.2021 directed the Respondents No. 3 and 4 not to interfere with the possession and enjoyment of the Petitioners in respect of the lands covered by Sy.No.58 of Budidapadu Village of YSR Kadapa District.
It is further submitted that the Respondent/ Police never called the Petitioners to the Police Station and never involved in the civil disputes between the Petitioners and Respondent No.5. 5. Recording the submissions made, the Writ Petition is disposed of. However, the Respondent/ Police are directed to follow due process of law regarding the dispute between the Petitioners and Respondent No.5. There shall be no order as to costs.
