ORDER:
The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioner/Accused for granting of pre-arrest bail in connection with Crime No.371 of 2025 of Prohibition and Excise Station Rajamahendravaram South, East Godavari District, registered for the alleged offences punishable under Section 7-B read with 8-A & 8-B of the Andhra Pradesh Prohibition Act, 2020.
2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record.

As seen from the record, there are five similar adverse antecedents reported against the petitioner/Accused i.e., Cr.No.73 of 2020, Cr.No.796 of 2020, Cr.No.838 of 2020, Cr.No.34 of 2023 and Cr.No.28 of 2025. The name of the petitioner is mentioned in the FIR, and he is alleged to have manufactured 400 liters of FJ wash. The petitioner is arraigned as the sole accused in this case. The learned counsel for the petitioner submits that it is highly difficult for anyone to identify a person from his back side at a distance. The learned Assistant Public Prosecutor submits that the petitioner is arraigned as the sole accused in this case.

4. In view of the specific allegations attributed against the petitioner/Accused and he involved in five similar adverse antecedents, which is one of the reasons for registration of this case, this Court is not inclined to grant pre-arrest bail to the petitioner/Accused. However, the
learned counsel for the petitioner requests this Court to grant liberty to the petitioner/accused to surrender before the learned Jurisdictional Magistrate concerned and move an appropriate application for his release before the said Court.

In the result, the Criminal Petition is disposed of , granting liberty to the petitioner/Accused to surrender before the learned jurisdictional Magistrate concerned within a period of one (01) week from the date of receipt of the copy of this order and move an appropriate application before the learned Jurisdictional Magistrate for enlarging him on bail. The learned Jurisdictional Magistrate shall endeavour to dispose of the application on its own merits in accordance with law by giving due and sufficient opportunity to both sides and pass appropriate orders within a reasonable time, preferably within two (02) days.
