This writ petition is filed aggrieved by the action of the respondents for non-payment of the bills for the works undertaken by the petitioner. 2. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development, the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for the respondent-Corporation. 3. The petitioner was entrusted with the work of providing internal pathways, fixing of manholes and removal of wet silt of internal drain from China Market to J.Ramaraopeta Centre in 22nd division, Kakinada Municipality. The petitioner was issued work order under agreement No.92/2023-24, dt.20.07.2023 and the petitioner completed the work in the year 2023 itself under the supervision of the concerned Engineering Department of the 2nd respondent Municipal Corporation and submitted a final bill for a sum of Rs.28,61,809/-. So far no payment has been made to the petitioner. 4. The learned counsel further submits that the petitioner submitted a representation on 18.09.2025 requesting the 2nd respondent to -3- W.P. No.26199 OF 2025 Date of order: 28.10.2025 release the bills for the work completed. It is submitted that the works entrusted are contingent works to the petitioner which was attended by the petitioner by deploying the required men. It is submitted that all the works were completed, however the bills were finalized and the payments were released. 5. The learned standing counsel for the 2nd respondent on oral instructions submits that the work was completed, however on account of lack of funds the bills could not be released. 6. Considering the submissions that the work completed by the petitioner is not in dispute and on account of the lack of funds, the bills of the petitioner could not be released, there shall be a direction to respondents 2 and 4 to verify and release the payments due payable to the petitioner within a period of six weeks. 7. With the above direction, the writ petition is disposed of. No costs. 8. Pending miscellaneous petitions, if any, shall stand closed. ___________________ JUSTICE HARINATH.N BV
