This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 292/24 registered at Police Station D.D. Nagar, Distt. Raipur (C.G.) for the offence punishable under Sections 331(4), 305, 3(5) of the Bhartiya Nyaya Sanhita, 2023. 2. The earlier bail application of the applicant was rejected by this Hon’ble Court vide order dated 21.04.2025 passed in MCRC No. 2982 of 2025, on the ground of the applicant’s criminal antecedents. 3. 2 was lodged by the complainant stating that on 11.06.2024, he had locked his house and gone to Jharkhand for ofÏce work. On 01.07.2024, at around 9:00 p.m., his neighbor informed him that the lock of the door of his house had been broken. On 03.07.2024, when the complainant returned home, he found that the lock of the door of his house was broken and his motorcycle — Honda Hornet 2.0 bearing registration no. CG-04-PQ-0528, engine no. MC56EA2003544, chassis no. ME4MC567JPA003127, model 2023, blue colour which was kept in the hall, was missing. In addition to the motorcycle, its documents and a silver plate worth about Rs. 90,000/- were stolen by some unknown persons. Based on the above complaint, Crime No. 292/2024 was registered under Sections 331(4), 305, and 3(5) of the B.N.S. at Police Station D.D. Nagar, District Raipur, and investigation was taken up. 4. Learned counsel for the applicant submits that this is the second bail application filed on the ground that the deposition of the prosecution witnesses examined so far has not supported the case of the prosecution. He further submits that the applicant has been languishing in jail since 10.410.2024, the conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 5. Learned counsel appearing for the State/non-applicant opposes the bail application and submits that the first bail application of the applicant was rejected on the ground of his criminal antecedents, i.e., seven cases under the IPC and BNS, which are still pending against him. Therefore, the present applicant is not entitled to the grant of regular bail in this case. 6.
I have heard learned counsel appearing for the parties and perused the case diary. 7. Considering the above submissions, since the first bail application of the
3 applicant was rejected on the ground of applicant’s criminal antecedents, i.e., seven cases under the IPC and BNS, which are still pending against him, therefore, I am not inclined to grant regular bail to the present applicant. 8. Accordingly, the second bail application of the applicant - Ashish Bande, involved in Crime No. 292/24 registered at Police Station D.D. Nagar, Distt. Raipur (C.G.) for the offence punishable under Sections 331(4), 305, 3(5) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 9. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial as expeditiously as possible within a period of four months from the receipt of a certified copy of this
order in accordance with law, if there is no legal impediment.
