1. Learned State Counsel submits that though the petitioner had claimed promotion in the present matter, the petitioner has unfortunately expired on 11.06.2023. Hence, this petition has perhaps become infructuous. It is further submitted that no application has been filed by the legal representatives of the petitioner for their substitution.
2. Learned State Counsel also submits that all retiral dues, including pension and other service benefits, have already been paid to the nominee, namely Smt. Anju Pal. Therefore, according to the learned State Counsel, there remains nothing to be adjudicated in this petition.
3. Considering the aforesaid facts and circumstances of the case, particularly the fact regarding the death of the petitioner and the Treasury Bill dated 14.08.2023 (BTR No. 5182930) showing payment of retiral dues to the legal representative Smt. Anju Pal (Mobile No. 9977122765), this Court finds that the petition has become infructuous.
4. Accordingly, the petition is disposed of as having become infructuous.
5. However, if any grievance still subsists, the concerned legal representative shall be at liberty to file a fresh petition challenging the alleged inaction on the part of the respondent authorities, if so advised. sd/- (Amitendra Kishore Prasad) Judge Vishakha
