The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the impugned order dated 01.03.2025 passed by Additional Sessions Judge, Court No. 5, Agra in Sessions Trial No. 1597 of 2024, (State Vs. Chhitariya and others) arising out of Case Crime No. 329 of 2021, under Sections 323, 308 of I.P.C., Police Station- Achhnera, District- Agra, whereby discharge application has been dismissed. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
