This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Case No. 1429 of 2018 arising out of case crime no. 360/ 2014 under Section 323, 504, 506 I.P.C., Police Station- Sarai Akil, District- Kaushambi pending in the Court of learned Additional Chief Judicial Magistrate/ Judicial Magistrate, Kaushambi within stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the matter is pending since 2018 at the stage of evidence but the learned trial Court is not taking any pain in disposal of the matter. 4. I have considered the submissions and perused the record. 5. It appears from perusal of the order sheets that the accused is not cooperating with the trial Court and on several dates has has been absent and at the same time the witnesses are also not appearing before the Court inspite of issuance of bailable warrants against them. 6. Since the accused is himself a defaulter and not appearing regularly before the trial Court, I do not think he is entitled for any relief for the direction to the trial Court for expeditious disposal of the case. However, the trial Court is directed to expedite this old matter unless the applicant/ accused cooperates with the trial. 7. With the above observations, the application stands disposed of.
