Pharmacy despite recommended by the 2nd Respondent, Regulatory Commission vide E file No. 2878582, Dated 05-07-2025 and thereby disabling the Petitioner institution to participate in the APEAPCET - 2025 Counselling, as being arbitrary, illegal and violative of Articles 14 and 19 of the Constitution of India and violative of A.P. Educational Institutions (Regulations of Admissions and Prohibition of Capitation Fee) Act 1983 and the Andhra Pradesh Higher Education Monitoring and Regulatory Commission Act and Rules, Regulations framed therein and consequently direct the 1st and 2nd Respondents to determine the fee structure for the Petitioner institution and issue such other writ or order or direction as deemed fit and proper in the circumstances of case IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondent to notify the tuition fee towards the Petitioner institution as recommended by the 2nd Respondent vide E file No. 2878582, Dated 05-07-2025 to the Petitioner-Instituti on for the block period 2025-26 to 2026-27, pending disposal of the Writ Petition, in the interest of justice and pass Counsel for the Petitioner: 1. VIVEKANANDA VIRUPAKSHA The Court made the following ORDER: The present Writ Petition has been filed, under Article 226 of the Constitution of India, seeking the following relief:- “…to issue an appropriate Writ more in the nature of Writ of Mandamus declaring the action of the 1st respondent in not notifying the tuition fee of the petitioner institution for the course B. Pharmacy despite recommended by the 2nd Respondent, Regulatory Commission vide E file No.2878582, Dated 05.07.2025 and thereby disabling the Petitioner institution to participate in the APEAPCET 2025 Counselling, as being arbitrary, illegal and violative of Articles 14 and 19 of the Constitution of India and violative of A.P.Educational Institutions (Regulations of Admissions and Prohibition of Capitation Fee) Act, 1983 and the Andhra Pradesh Higher Education Monitoring and Regulatory Commission Act and Rules, Regulations framed therein and consequently direct the 1st and 2nd Respondents to determine the fee structure for the Petitioner institution .” 2. This Court, on 23.07.2025, passed the following interim order. “……… Hence, the 1st respondent is hereby directed to pass appropriate orders on the recommendation made by the 2nd respondent within a period one (1) week from the date of receipt of this order.” 3. Today, when the matter came up for hearing, learned counsel for the petitioner submits that no further orders are necessary to be passed in the present Writ Petition. 4. Recording the said submission, the Writ Petition is closed. There shall be no order as to costs.
