No.6915 of 2025 ORDER : The Court made the following order :- The petitioner / A11 who was arrested and remanded to judicial custody on 29.08.2023 for the offences punishable under Sections 8(c)r/w. 20(b)(ii)(c), 25,29(1) of NDPS Act in Crime No.584 of 2023 on the file of the respondent police seeks bail. 2. The case of the prosecution is that on 28.08.2023 at about 13.00 hrs based on the secret information that the first accused Aron along with his men had obtained ganja from Andhra Pradesh and stocked the same at Pondicherry and had planned to illegally transport the same to Srilanka and in pursuance to the same they were moving the contraband to Thoothukudi on 28.08.2023 at about 15.00 hrs by their cars bearing Reg.Nos.TN 07 CK 2123 and TN 22 CH 3280. The police party proceeded to the spot and found the accused persons in illegal possession of 228kgs of ganja. Hence the case. 3. The learned counsel for the petitioner would submit that the respondent police has registered a false case against the petitioner and he has not committed any offence as alleged by the prosecution. The petitioner has been arrested and remanded to judicial custody on 29.08.2023. He 2/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.6915 of 2025 would further submit that except this case no other case is pending against the petitioner. He would further submit that already this Court had directed the trial Court to complete the trial within the stipulated time but however the trial Court is not able to dispose the case and the petitioner is jail for a long time and further it is not possible to dispose the case within the short span of time. Hence, he prays to grant bail to the petitioner. 4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner along with other accused were found in illegal possession of 228kgs of ganja which is a commercial quantity. He would further submit that the investigation in this case is completed and the case stands posted for examination of the investigation officer. He would further submit that the earlier petition filed by the petitioner was dismissed by this Court and there is no change in the circumstances of the case to consider the present petition. Hence, he opposed to grant bail to the petitioner. 5. This Court heard both sides and perused the materials available on record. 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.6915 of 2025 6. Considering the rival submissions made by the learned counsel on either side and also the fact that the quantity involved in this case is a commercial quantity and already this Court had dismissed the application submitted by the petitioner for bail and there are no change in circumstances except non completion of trial within the time stipulated by this Court and now the case is posted for examination of the investigation officer and some of the accused have not cross examined the investigation officer and the trial Court allowed the petition filed by the some of the accused persons for cross examination of the investigation officer, at this stage this Court is not inclined to grant bail to the petitioner. 7. Hence the petition stands dismissed. However considering the long pendency of the case the trial Court is directed to complete the trial without granting long adjournments beyond three days. If no Presiding Officer is available in the court, the in-charge Presiding Officer shall conduct the case by following the above said directions.
