KOTA URBAN POLICE STATION, CHITTOOR DISTRICT ...RESPONDENT/COMPLAINANT(S): Counsel for the Petitioner/accused: M SIVA KUMAR Counsel for the Respondent/complainant(S): PUBLIC PROSECUTOR 2 Dr. YLR, J Crl.P.No.10516 of 2025 Dated 23.10.2025 The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioner/Accused for granting of pre-arrest bail in connection with Crime No.49 of 2025 of V.Kota UPS Police Station, Chittoor District, registered for the alleged offence punishable under Sections 309 (4) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, the Station House Officer, V. Kota Police Station, has issued a notice under Section 35(3) of ‘the BNS’/41-A of ‘the Cr.P.C.,’ dated 23.07.2025, to the petitioner, who is not shown as an accused in any case. In the notice it was mentioned that during the interrogation of Accused No.5/Vedhachalam after his arrest, he stated that the petitioner shared his mobile number with Jayapal. In view of the above, the Inspector of Police, V. Kota Police Station, to aid the investigation, called the petitioner to the Police Station by issuing the notice. The petitioner is a male, aged about 69 years, and he is a 3 Dr. YLR, J Crl.P.No.10516 of 2025 Dated 23.10.2025 permanent resident of Devalapuram Village and Town, Ambur Taluk, Vellore District, Tamil Nadu State. He has got fixed abode. 4. The learned Assistant Public Prosecutor submits that pursuant to the notice issued by the Inspector of Police, V. Kota Police Station, the petitioner has not responded or attended before the police. The learned counsel for the petitioner submits that due to the petitioner’s ill health, he could not attend before the police. 5. Be that as it may, the petitioner is required to cooperate with the Police Officer, who is conducting the investigation. The petitioner is not yet shown as an accused in this case, as observed supra. Therefore, the question of grant of pre-arrest bail would not arise. 6. In the result, the Criminal Petition is disposed of, directing the petitioner/Accused to cooperate with the Investigating Officer as and when required. If the role of the petitioner in the alleged offence comes to light during the investigation, the Investigating Officer shall be at liberty to proceed in accordance with law. _________________________ DR.
