Heard learned counsel for the applicants, learned A.G.A. for opposite party no. 1 and Sri Swatantra Kumar for opposite party no. 2. 2. Supplementary affidavit filed today is taken on record. 3. This application has been filed challenging the entire criminal proceedings of Criminal Case No. 2807 of 2021, arising out of Case Crime No. 1294 of 2015, under Sections 420, 467, 468, 471 of I.P.C., Police Station- Sihani Gate, District- Ghaziabad, pending in the court of Additional Chief Judicial Magistrate, Court No.-3, Ghaziabad as well as order dated 13.02.2025 passed by Additional Chief Judicial Magistrate, Court No.-3, Ghaziabad on the basis of compromise settlement dated 13.02.2025 occurred between the parties. 4. Pursuant to previous order of this Court, compromise dated 13.02.2025 has been verified by the court concerned. The order dated 04.07.2025 passed by the learned Additional Chief Judicial Magistrate is appended along with the supplementary affidavit. 5. Considering the amicable settlement of dispute between the parties, nature of allegations and in view of the law laid down by the Hon'ble Supreme Court in Gian Singh vs. State of Punjab and another; (2012) 10 SCC 303 and Nikhil Merchant vs. Central Bureau of Investigation and another; (2008) 9 SCC 677, the application deserves to be allowed.
