For the Resp.-State : Mr. Mithilesh Singh, G.A.-IV --------- 15/06.08.2025 The instant writ application has been preferred by the petitioner for quashing of the report of the three men committee constituted in light of the judgment of the Hon'ble Supreme Court, by which the recognition of the service of the petitioner has been refused on frivolous ground so far as the petitioner is concerned by issuing of an appropriate writ; And this is an application for issuance of an appropriate writ/writs, direction/directions directing the respondents to 2025:JHHC:22161 consider the claim of the petitioner for recognition of service of the petitioners on the post of Assistant Teacher School, Kamdara, P.O-of Girls' Project .P.S-Kamdara High District- Gumla (hereinafter referred to as the school") and to pay him salary w.e.f. 01.01.1989 with all consequential benefits in terms of the Govt. letter no. 142 dated 04.02.1989 following the judgment and order pronounced by the Full Bench of the Hon'ble Patna High Court passed in Project Uchcha Vidyalaya Shishak Sangh and other cases reported in 2001) PLJR 287, which has been affirmed by the Apex Court in Civil Appeal No. 662681 of 2001 and further in view of the recommendation of the three men committee constituted in the State of Bihar in terms of the order of the Court referred above, which is the authorized committee; And further in view of the letter as contained in Memo No. 2743 dated 6.10.2012, by which the State Government decided to recognize the service of the teacher either they were trained or untrained whose appointment was made prior to 4.2.1989 in view of the order of dated 13.4.2016 passed by the Hon'ble Court in W.P.(S) No-3833 of 2014 and further to pay all other consequential benefits along with appropriate interest of the entire amount. 2. After hearing at length, learned counsel for the petitioner submits that similar issues are pending before the 2025:JHHC:22161 Hon’ble Apex Court in S.L.P. No. 8120 of 2024; wherein the right of the teachers of Project Girls’ School is under consideration; as such, the instant writ application may be disposed of by giving liberty to this petitioner to approach the concerned respondent, if the Hon’ble Apex Court decides the case in favour of the teachers of the Project Girls’ School. 3. Learned counsel for the respondent does not oppose the aforesaid contention. 4. Having regard to the aforesaid submission of the learned counsel for the petitioner, the instant writ application stands disposed of by clarifying that if the order of the Hon’ble Apex Court will help the case of the petitioner, then he would approach the concerned respondent. The concerned respondent in turn, will look into the order of the Hon’ble Apex Court and verify the records of the petitioner and take a decision with regard to benefits to be given. 5.
