Heard both sides. 2. The applicant seeks condonation of delay of 5032 days caused in preferring first appeal. For the reasons stated in the application, it is desirable to condone the delay. 3. The learned counsel for the respondent No. 3 – acquiring body oppose the application on the ground there here is huge delay and no sufficient grounds are mentioned to contone the delay. 2025:BHC-AUG:37710 2 P 02 ca 15003.22 4. The contents of the application have not been controverted by the respondents by filing any reply. The applicant has shown readiness to give up the interest and statutory benefits for the delayed period. There are no malafides on the part of the applicant to prefer the first appeal belatedly. 5. For the reasons stated in the application the civil application is allowed. The delay is condoned on condition that the applicant shall not be entitled to claim interest and statutory benefits for the delayed period. Office shall register the first appeal.
