GP FOR IRRIGATION COMM AREA DEV The Court made the following: 3 VS,J W.P.No.408 of 2022 The Court made the following Order: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:- “… to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in withholding the payment o amount Rs. 3,05,973/- payable to the petitioner in relation to the execution of work under Work ID No. 6011505057, i.e., Desilting and improvements to Feeder channel from Arunakunta tank to Pedda tank in Reddigudem (V) in Reddigudem (M) of Krishna District, for the year 2018-2019 vide Agreement No1052/2018-2019 dated 20.12.2018 as illegal, arbitrary, in violation of Article 14 of the Constitution of India and consequently direct the respondents to pay an amount of Rs. 3,05,973/- @ 9% interest due to the petitioner in respect of execution of afore mentioned works forthwith ….” 2. When the writ petition came up for admission on 11.03.2022, this Court was pleased to pass the following interim direction in I.A.No.1 of 2022: “In the circumstances, the respondents are directed to pay the approved and final bill amount due to the petitioner within a period of six (6) weeks from the date of receipt of a copy of this order.” 3. As the said order was not complied with the respondents, the petitioner was constrained to file Contempt Case No. 2927 of 2022. The said contempt case was closed basing on the report submitted by the respondents, stating that the orders passed by this Court on 11.03.2022 has been complied with and the same was not objected by the learned counsel for the petitioner, vide orders dated 20.06.2024. 4 VS,J W.P.No.408 of 2022 4. In view of the same, this Court is of the opinion that no further orders are necessary in the present writ petition. However, the learned counsel for the petitioner has stated that, as per the oral instructions received, the petitioner is yet to receive an amount of Rs.30,000/- from the respondents. 5. Accordingly, the Writ Petition is closed, granting liberty to the petitioner to submit a fresh representation to the concerned authorities for release of the said amount, if it remains unpaid.
