This is a petition under Article 226 of the Constitution of India for seeking the following relief(s): i. Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to grant the benefit of movement to higher grade of Junior Engineer (Elect.) Grade-V(A) [erstwhile Junior Engineer (Electrical), Grade-I] to the Petitioner, w.e.f. 06.09.2004, i.e., the date of completion of 4(four) years of his service as Junior Engineer (Electrical), Grade-II & consequently, release the arrears of all benefits flowing therefrom. ii. Make the rules absolute. iii. Call for records. iv. Pass any further order/orders as this Hon'ble High Court considered fit and proper. [3]
It is the case of the petitioner that the Petitioner has prayed for necessary directions from this Court upon the respondents to grant the benefit of movement to higher grade of Junior Engineer (Elect.) Grade-V(A) [erstwhile Junior Engineer (Electrical), Grade-I] to the Petitioner, w.e.f. 06.09.2004, i.e., the date of completion of 4(four) years of his service as Junior Engineer (Electrical), Grade-II & consequently, release the arrears of all benefits flowing therefrom. Aggrieved by conduct of the respondents the petitioner has filed this writ petition. [5]
On bare perusal of the record it surfaces that the petitioner made a representation dated 04.11.2024 which has not been acted upon till date by the respondents. [6]
In view of above submission, without expressing any opinion on the merits of the case, this present writ petition is disposed of directing the respondents to consider the case of the petitioner in the light of the representation dated 04.11.2024 in accordance with law within a period of three months from the date of receipt of copy of this order. [7]
With the above observation and direction, this present writ petition stands disposed of. As a sequel, stay, if any, stands vacated. Pending application(s), if any, also stands closed.
