HC-KAR NC: 2025:KHC:40443 WP No. 34428 of 2016 ORAL ORDER The petitioner had challenged the Official Memorandum at Annexure-G which was the order by virtue of which the Deputy Commissioner had set apart an extent of 01 Acre in Sy.No.65 for the use of the 5th respondent. The order of the Deputy Commissioner was dated 31.05.2014. 2. It was the case of the petitioner that the land that was originally allotted to the petitioner's vendor was overlapped by the order of the Deputy Commissioner at Annexure-G.
3. During the pendency of the proceedings, it was pointed out that the land allotted to the 5th respondent has been demarcated as per the sketch, copy of which is enclosed as per Annexure-H along with the application for amendment. 4.
Further it is submitted that the location of extent of land allotted to the 5th respondent has been explained

HC-KAR NC: 2025:KHC:40443 WP No. 34428 of 2016 and has been revised compared to the earlier allotment to the 5th respondent. 5. The application seeking for amendment is allowed and the documents and pleadings along with the application are permitted to be made a part of the original writ proceedings. 6. Learned counsel for petitioner submits that the revised location of land allotted to the 5th respondent in terms of the sketch at Annexure-H as also note at Annexure-J would not affect the interest of the petitioner, and the grievance the petitioner had raised does not survive due to the subsequent development. 7. Taking note of the same, the petition is disposed off in light of the stand of the petitioner noticed above. 8. In light of the revised location of the land allotted to respondent no.5 as is evidenced at Annexure-H and J, it would be appropriate to observe that the location of the property of respondent no.5 would be in terms of the

HC-KAR NC: 2025:KHC:40443 WP No. 34428 of 2016 sketch at Annexure-H and note at Annexure-J which would supersede the location made as per the original allotment at Annexure-G.
