Cr. MP(M) No. 446 of 2024 The supplementary affidavit of Mr. Abhishek Mishra, Advocate has been filed who was representing the applicant before the learned Trial Court stating that he failed to communicate the decision of the learned Trial Court to the applicant. No counter affidavit has been filed in the present case. Since, the learned counsel has filed the affidavit stating that it was his mistake that he could not communicate the decision of the learned Trial Court to the applicant, therefore the applicant/ complainant cannot be penalized for the negligence on the part of the counsel. Hence, the application is allowed and the delay in filing the appeal is ordered to be condoned. Accordingly, application stands disposed of. Cr.MP(M) No. 2037/ 2025 (Cr. MPMST No. 648 of 2024) The delay in filing of the appeal has been ordered to be condoned as per the order passed in Cr.MP(M) No. 446 of 2024. It be registered. Notice. Mr. Bhisham Sharma, learned counsel for the respondent, appears and waives service of notice on behalf of respondent/accused. Copy of appeal be supplied within a week. Record has been received.
