Neutral Citation No. - 2025:AHC:43098 Court No. - 82 Case :- CRIMINAL REVISION No. - 147 of 2025 Revisionist :- Akram Ashraf Shaikh Opposite Party :- State of U.P. and Another Counsel for Revisionist :- Akash Chaubey,Sonal Bharti Counsel for Opposite Party :- G.A. Hon'ble Manjive Shukla,J. 1. Heard learned counsel appearing for the revisionist and learned Additional Government Advocate appearing for the State. 2. Learned counsel appearing for the revisionist, at the very outset, submits that the revisionist wants to withdraw this revision and wants to face trial before the trial court. 3.Learned counsel appearing for the revisionist further submits that the only apprehension in the mind of the revisionist is that the trial court had passed another order on 6.3.2025 whereby, the notice had been issued to the revisionist stating therein that he is not cooperating with the trial therefore, why his bail may not be cancelled. 4. Learned counsel appearing for the revisionist has submitted that the revisionist is ready to appear before the trial court on the next date fixed in the trial i.e. on 26.3.2025 and he shall cooperate with the trial therefore, the trial court may not act upon the notice issued to the revisionist for cancellation of his bail. 5. I have considered the submissions advanced by the learned counsel appearing for the revisionist. 6. The instant criminal revision is dismissed as withdrawn. 7. So far as the order dated 6.3.2025 passed by the trial court, which has been placed before this Court, wherein notice had been issued to the revisionist on the ground that he is not cooperating with the trial is concerned, this Court is of the view that if the revisionist appears on 26.3.2025 before the trial court and cooperates in the trial, the trial court may not cancel the bail, already granted to the revisionist. 8. It is made clear that the aforesaid observation/ direction of this Court does not preclude the trial court to initiate the proceedings for cancellation of bail of the revisionist, at any subsequent stage, if he does not cooperate with the trial.
