P.P. ------ Order No.02 Dated- 21.03.2025 Heard the parties. Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Bagdehri P.S. Case No. 25 of 2018 arising out of P.C.R. Case No. 33 of 2018 (G.R. No. 330 of 2023) for the offence registered under Section 420, 406, 467, 468, 471, 120B of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is that on being recommended by the petitioner the informant invested certain money in the Basil International Company and for which the informant was provided with appropriate certificate. It is further submitted that the allegations against the petitioner are all false. It is next submitted that though it is alleged that the petitioner is the director of Basil International Company but the same is false and the petitioner is no way connected with the said company and there is absolutely no document to show that the petitioner was in any manner responsible for the said investment of the informant; for which certificate of investment has admittedly been granted to him by the company concerned. It is also submitted that the petitioner undertakes to cooperate with the investigation of the case and also undertakes to furnish sufficient security including cash security. It is lastly submitted that the co- accused person has already been given the privilege of anticipatory bail by this Court vide order dated 14.01.2019 in A.B.A. No.8239 of 2018. Hence, it is submitted that the petitioners be given the privilege of anticipatory bail. The learned Addl. P.P. opposes the prayer for anticipatory bail. Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that this is a fit case where the petitioner, named above, be given the privilege of anticipatory bail. Hence, in the event of his arrest or surrender within a period of six weeks from the date of this order, he shall be released on bail on depositing Rs. 10,000/- as cash security and furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Jamtara, in connection with Bagdehri P.S. Case No. 25 of 2018 arising out of P.C.R. Case No. 33 of 2018 (G.R. No. 330 of 2023) subject to the condition laid down under section 482 (2) of BNSS, 2023 with further conditions: I. the petitioner will co-operate with the investigation, II. the petitioner will appear before the Investigating Officer as and when noticed. III. The petitioner will furnish his mobile phone number by way of filing affidavit in the court below and will undertakes that he will not change his mobile phone number during the pendency of this case. If Investigating Officer requires mobile phone number of the petitioner, he can make appropriate prayer before the trial court and on such prayer being made the court below will provide mobile numbers of the petitioners to the Investigating Officer.
