HARI BABU MAGULURI SC For SERP The Court made the following: ::ORDER:: Heard Sri Suresh Kumar Reddy Kalava, learned counsel for the petitioner and Sri Hari Babu, learned Standing counsel appearing for respondents. 2. The above contempt case is filed complaining about the violation of the order dated 18.10.2024 in W.P.No.23451 of 2024. 3. The petitioner filed the aforementioned writ petition to declare the action of respondents in orally directing the petitioner not to attend duties as Village Organisation Assistant (VOA) in Sonneganipalle-I Grama Samakhya Mutually Aided Cooperative Thrift and Credit Society Limited, Gundisettypallil Village, Santhipuram Mandal, Chittoor District, as illegal and arbitrary. 3. The writ petition was disposed of on 18.10.2024. The operative portion of the order reads as follows: “Given the facts and circumstances of the case coupled with the aforementioned circular issued by the Principal Secretary, SERP, and the oral instructions of the learned Assistant Government Pleader for Services, this Writ Petition is disposed of at the admission stage, with the consent of the learned counsel on either side, directing the respondents 2 to 4 not to interfere with the petitioner’s discharging duties as VOA of 5th respondent Society, Sonneganipalli-I Village, Santhipuram Mandal, Chittoor District. However, this order will not preclude the respondent authorities from acting as per the Rules. No order as to costs.” 3 4. In the affidavit filed in support of the contempt case, it is pleaded that whenever the petitioner attended the office, the respondents restrained her from discharging duties as Village Organisation Assistant (VOA). 5. The 2nd respondent filed a counter-affidavit and annexed a resolution dated 05.07.2024 of the Society. A perusal of the resolution shows that the members of the society elected Smt. V.M.Prema W/o. Balachandra as Village Organisation Assistant on 05.07.2024 by removing the petitioner. 6. No reply affidavit was filed to the counter-affidavit filed by the 2nd respondent. 7. Thus, as on the date of disposal of the writ petition, the petitioner was not continuing as Village Organisation Assistant (VOA) of the society. 8. Given the facts and circumstances, this Court does not find any violation of the order in the writ petition. Accordingly, the contempt case is dismissed. There shall be no order as to costs.
