This is an application under Section 482 of the BNSS 2023, whereby the petitioner, Bhola Tanti has prayed for pre-arrest bail apprehending arrest in Page No.# 2/3 connection with Silchar Police Station Case No. 1139/2024 under Section 87 of the BNS, 2023. The informant wanted to give his 15 years old sister to the present petitioner in marriage. But the parents of the informant and his family were against the proposal because the girl was minor. On one occasion, the girl went to attend her tuition classes, but she did not return home and therefore, the informant on the suspicion that the present petitioner might have kidnapped her, lodged the FIR. The girl was recovered and she had given statement wherein she stated that she went with the petitioner on her own. The girl has not implicated the present petitioner on the allegation of kidnapping. I have heard the learned counsel for both the sides. Under the aforesaid facts and circumstances, the petitioner does not deserve to be detained in custody and as such, his pre-arrest bail application is allowed. It is directed that the petitioner, Bhola Tanti who is apprehending arrest in connection with Silchar Police Station Case No. 1139/2024 shall be released on pre-arrest bail on furnishing bail bond of Rs.20,000/- with a suitable surety of like amount to the satisfaction of the arresting authority. The petitioner shall co- operate with the police investigation as and when called for. With the aforesaid direction, the pre-arrest bail application stands disposed of. Case diary be returned back.
