U/S 397 R/W 401 CR.P.C (U/S 438 R/W 442 BNSS) IS FILED TO SET ASIDE THE JUDGEMENT DATED 16.11.2024 BY THE VII ADDITIONAL SESSIONS JUDGE AT MYSURU AND SET ASIDE THE JUDGEMENT DATED 02.05.2024 PASSED BY V J.M.F.C. AT MYSURU IN C.C.NO.429/2020 AND ETC. THIS PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED:
CONCILIATION ORDER
This revision petition is filed by the petitioner against the order dated 16.11.2024 in Crl.A.No.213/2024 passed by the VII Additional Sessions Judge, Mysuru and the order of conviction dated 02.05.2024 in C.C.No.429/2020 passed by the V JMFC, Mysuru, The trial Court ordered payment of Rs.4,05,000/-. The order of the trial Court came to be confirmed in criminal appeal. 2. The learned Counsel appearing for the petitioner is present. 3
3. A joint memo signed by the learned advocates appearing for the petitioner, respondent and their respective parties is filed. The parties have agreed to settle the matter for Rs.2,30,000/- in full and final settlement. 4. As per the joint memo, petitioner has paid a sum of Rs.50,000/- through UPI and Rs.99,000/- by cash to the complainant-respondent and petitioner has agreed to allow the complainant-respondent to withdraw the sum of Rs.81,000/- which is in deposit in C.C.No.429/2020 before the V JMFC, Mysuru. 5. In view of the above, it is submitted that the parties have settled the dispute and no sums are due. 6. In the light of the joint memo, the judgment dated 16.11.2024 passed in Crl.A.No.213/2024 by the VII Additional Sessions Judge, Mysuru and order dated 02.05.2024 passed in C.C.No.429/2020 by the V JMFC,
4 Mysuru, are set aside and modified to the extent agreed to in the joint memo. The petitioner is acquitted of the offence punishable under Section 138 of N.I. Act. The revision petition stands disposed of.

The parties to the Joint Memo respectfully submits that, the respondent /Complainant has filed the PCR against the Petitioner/accused For dishonour of the Cheque bearing No.794374 dated 16/09/2019 for a sum of Rs.4,00,000/- under Section 138 of the Negotiable Instruments Act, 1881. The same was registered in No. CC.No.429/2020 on the file of the Court of the V JMFC at Mysore. The said complaint came to be allowed and accused was convicted. The accused aggrieved by the said order has filed appeal in Crl.A. No.213/2024 before the District and Sessions Court, Mysore which also came to be dismissed. Aggrieved by the said order the above revision Petition was filed. The parties have amicably settled the dispute and have agreed to compound the offence. 6 and final settlement of the cheque in question and accordingly, the respondent/Complainant has agreed to receive Rs.2,30,000/- as full and final claim in respect of the Cheque bearing No.794374 dated 16/09/2019 involved in the present petition and accordingly have settled the matter on following term:
1. The Accused/ petitioner has paid a sum of Rs.50,000/- to the Complainant /respondent through UPI payment through phonepe ID No.9341463804@ybl on 04/03/2025 towards payment of agreed amount of Rs.2,30,000/-. The complainant/respondent has acknowledges the receipt of said amount towards part of full and final settlement of the cheque amount. 2. The Accused/petitioner has paid a sum of Rs.99,000/- by cash to the Complainant /respondent on 31/03/2025 towards the payment of the settlement amount. The complainant/respondent acknowledges the receipt of said amount. 3.
The Accused/petitioner has no objection to withdraw the sum of Rs.81,000/- deposited by him in C.C.No.429/2020 before the Hon'ble V JMFC At Mysore. The complainant/respondent has agreed to withdraw the said amount in deposit before the Hon'ble V JMFC At Mysore, towards the full and final settlement of the cheque amount. _____________________________________________________________ Sd/-

The Complainant has thus received in all a sum of 2,30,000/- being the settlement amount as agreed from the accused/petitioner and absolves the petitioner herein from payment of any amount in respect of the cheque in question in the manner. 5. Both parties agree to withdraw all claims and counter-claims arising out of the said transaction. 6. The parties request the Hon'ble Court to allow the compounding of the offence and quash the proceedings. In view of the settlement, the parties to the joint memo respectfully pray that this Hon'ble Court may be pleased to record the joint memo and dispose of the above petition on the said terms In the interest of justice. The parties to the joint memo have entered compromise without there being any influence, threat, undue influence or coercion and signed. Sd/-
