YLR, J Crl.P.No.8768 of2025 Dated 27.10.2025 The Court made the following: ORDER; The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioner/Accused for granting of pre-arrest bail in connection with FIR No.255 of 2025 of Proddatur I Town Police Station, YSR Kadapa District, registered for the alleged offences punishable under Sections 333, 118(1), 115(2), 324(4) and 308(5) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, the petitioner is aged about 17 years and is a girl. Accused Nos.1 and 3 have already been enlarged on bail by this Court in Crl.P.No.8964 of 2025 vide order dated 12.09.2025. The petitioner is shown as Accused No.2. The de-facto complainant suffered four injuries. There are no adverse criminal antecedents against the petitioner. 4. This Court, in Crl.P.Nos.8787 and 8789 of 2025, vide order dated 12.09.2025, granted pre-arrest bail to Accused Nos. 19 and 20, as they
3 Dr. YLR, J Crl.P.No.8768 of 2025 Dated 27.10.2025 were of impressionable age, being 17 years old. The petitioner in the instant case is also a minor represented by her mother. It is not in dispute that the petitioner is a juvenile. The petitioner is alleged to have committed an incident which attracts the provisions of ‘the BNS’. 5. Section 12 of the Juvenile Justice Act enables the Court to grant bail to the petitioner, who was allegedly found in conflict with law. The offence alleged is cognizable and non-bailable. The petitioner apprehends that she would be brought before the Board. 6. As observed supra, there are no adverse antecedents, the petitioner is at an impressionable age of 17 years and is a girl. If one more opportunity is given to the petitioner by allowing this petition, the ends of justice would be sub-served. 7.
Considering the gravity and nature of the allegations leveled against the petitioner/accused, this Court deems it fit to grant pre-arrest bail to the petitioner/accused. A
8. In the result, the Criminal Petition is allowed with the following \ conditions: i. In the event of apprehension of the petitioner, the petitioner/accused shall be enlarged on bail on her
4 Dr. YLR,J Crl.P.No.8768 of2025 Dated 27.10.2025 executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty-Five Thousand only) with two sureties for a like sum each, to the satisfaction of the arresting police officials. ii. The District Probation Officer shall supervise the conduct of the petitioner/Accused and submit a report to the Juvenile Justice Board once in three months till the conclusion of the enquiry before the learned Juvenile Justice Board. iii. The Petitioner/Accused shall not commit or indulge in commission of any offence in future. iv. The petitioner/Accused shall not cause any threat, inducement or promise to the prosecution witnesses;
