JUSTICE PRAVEER BHATNAGAR Order 05/03/2025 These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 10/2025 registered at Police Station Pahadi, District Deeg for the offence(s) under Sections 319(2), 318(4), 338, 336(3), 340(2), 308(2) and 61(2) (b) of BNS and Section 66-D and 66-E of IT Act. Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in this case. Offences alleged to have been committed by petitioners are triable by Magistrate. The recovery of mobile phones, sim cards etc. have already been effected, the accused petitioners are in custody since long and the trial of the case will take considerable time, therefore, the benefit of bail may be granted to the accused- petitioners. Per contra, learned Public Prosecutor opposes these bail applications and contended that the recovery of mobile phones, sim cards etc have been effected from the possession of petitioners, therefore considering the allegations levelled against the accused-petitioners their bail applications deserves to be dismissed. Considering the arguments advanced by the counsel for the parties and looking to the fact that offences alleged to have been committed by petitioners are triable by Magistrate. The accused petitioners are in custody since long and the trial of the case will take considerable time, without commenting anything on the [2025:RJ-JP:9792] (3 of 3) [CRLMB-1559/2025] merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. Accordingly, these bail application under Section 483 BNSS are allowed and it is ordered that the accused-petitioners 1. Mustafa S/o Aasu, 2. Rahul S/o Aasu, 3. Aarif S/o Jakar, 4. Adil S/o Shermohammad, 5. Sahil S/o Hasan, in connection with FIR No. 10/2025 registered at Police Station Pahadi, District Deeg shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
