ORDER:-
The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“…to issue a writ, order or direction more particularly one in nature of Writ of Mandamus declaring by the inaction on the part of the respondents in paying bills for an amount of Rs.9,92,000/- for the works executed by the petitioner by work name
“Restoration of Thathakunta near Gangireddygaripalli H/o Mallu (v) in Chinnamandem (M) of YSR District” vide Agreement No.287 silt/ 2018-19, dated 25-01-2019, DR No.287/2018-19 for an amount of Rs.9,92,000/-, as arbitrary, illegal, contrary to the settled legal position apart from being voilative of fundamental rights guaranteed to the petitioner under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondents to pay an amount of Rs.9,92,000/- for the works executed by the petitioner by work name “Restoration of Thathakunta near Gangireddygaripalli H/o Mallu (v) in Chinnamandem (M) of YSR District vide Agreement No.287 silt/ 2018-19, dated 25-01-2019, DR No.287/2018-19 for an amount of amount of Rs.9,92,000/- ....”
2. Today, when the matter came up for hearing, Mr.Sanaga Ashok Kumar,
learned counsel for the petitioner has stated that he was unable to contact his client. Therefore, sought permission of this Court to withdraw the writ petition with liberty to file a fresh writ petition, if at all the petitioner has any grievance in future.
3. Considering the said request made by the learned counsel for the petitioner, the Writ Petition is dismissed as withdrawn, granting liberty as prayed for. There shall be no order as to costs.
