Accused No.1 in Crime No.109/2024 registered by Ramanagar CEN Police Station, Ramanagar, for offences punishable under Sections 336 and 338 of BNS, 2023 and Sections 66, 66 (c), 66(D) of the Information Technology Act, 2008 is before this Court under Section 438 of Cr.PC seeking anticipatory bail.
2. Heard the learned Counsel for the parties.
3. FIR in Crime No.109/2024 was registered by Ramanagar CEN Police Station, Ramanagar, for the aforesaid offences against the petitioner herein, based on the FIR dated 21.10.2024 received from one Munilinge

Apprehending arrest in the said case, petitioner had filed Crl.Misc.No.425/2025 before the Jurisdictional Sessions Court which was rejected on 30.05.2025. Therefore, petitioner is before this Court.

Learned Counsel for the petitioner submits that there are no serious allegations against the petitioner, who has no criminal antecedents and the petitioner is ready to cooperate with the police for the purpose of investigation. Accordingly, he prays to allow this petition.
5. Per contra, learned HCGP submits that during the course of investigation, the petitioner had coopearated before the investigating officer and his confession statement is recorded.
6. FIR in the present case is registered against the petitioner for the aforesaid offence based on the FIR received from the jurisdictional Labour Inspector. The alleged offences are not exclusively punishable with death

7. Learned HCGP has brought to the notice of this Court that the petitioner has cooperated with the police for investigation and his confession statement is already recorded.
8. The Hon'ble Supreme Court in the case of Siddharam Sattlingappa Mhetre Vs. State of Maharashtra and Others reported in 2011 (1) SCC 694 has observed that, in the event, it is found that the accused had cooperated with the police for the purpose of investigation, in normal circumstances, the prayer for anticipatory bail needs to be answered affirmatively. The petitioner has undertaken to cooperate with the police for the purpose of further investigation.
9. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of

HC-KAR NC: 2025:KHC:25743 CRL.P No. 8629 of 2025 anticipatory bail needs to be answered affirmatively. Accordingly, the following:
ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.109/2024 registered by Ramanagar CEN Police Station, Ramanagar, for offences punishable under Sections 336 and 338 of BNS, 2023 and Sections 66, 66 (c), 66(D) of the Information Technology Act, 2008, subject to the following conditions:
1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the investigating officer.

2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon.
