2025:HHC:2892 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No. 869 of 2025 Decided on: 10.01.2025 Nikka Ram … Petitioner Versus The State of H.P. & others … Respondents Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge. Whether approved for reporting?1 ____________________________________________________ _ For the petitioner: Mr. Mandeep Chandel, Advocate. For the respondents: Mr. Pushpinder Jaswal, Additional Advocate General, for the respondents-State. Ajay Mohan Goel, Judge (Oral) Notice. Mr. Pushpinder Jaswal, learned Additional Advocate General, accepts notice on behalf of the respondents-State. 2. By way of this petition, the petitioner has assailed Office Order dated 06.01.2025 (Annexure P-2), in terms whereof, he has been transferred from GHS Karer, Hamirpur to GMS Hara Mehta. On a query put to learned counsel for the petitioner he informed the Court that the petitioner has already completed his normal tenure of three years at Karer. Before serving at Karer, he was serving at Nehalwin, under the complex of GSSS Bhota, Distt. Hamirpur, H.P. since the year 2019. This means that as from the month of November, 2019, the petitioner has been serving in District Hamirpur. 3. Learned counsel for the petitioner further informed the 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:2892 Court that distance between Nehalwin and Karer was about 20 kilometers, which further demonstrates that the petitioner has been serving within a radius of 20 kilometers for the last more than five years. 4. In the light of this fact, this Court does not finds any illegality in the transfer orders and the contention of the petitioner that he has been transferred on the basis of a D.O. Note also does not weigh with the Court for the reason that once the petitioner had already completed a tenure of more than five years within a radius of 20 kilometers, of course he has to now go and serve at the station where he stands transferred. 5. The petition stands disposed of. Pending miscellaneous applications, if any, also stand disposed of accordingly. (Ajay Mohan Goel) Judge January 10, 2025 (Rishi)
