The Criminal Petition has been filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.’)/ Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the petitioner/Accused No.1 on bail in Crime.No.53 of 2019 of Chinturu Police Station, East Godavari District, registered against the petitioner/Accused No.1 herein for the offences punishable under Sections 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, in connection with Cr.No.59 of 2025 of Chinturu Police Station, the petitioner/Accused No.1 was arrested and later enlarged on bail, and the case was numbered as NSC No.7 of 2020, pending on the file of the learned I Additional Sessions Judge, East Godavari, Rajamahendravaram. An NBW was issued against the petitioner on 22.03.2022. Subsequently, the police executed the warrant and produced him before the learned Trial Court on 01.08.2025. For the

past more than three years, the petitioner was absconding. The learned Trial Court observed that because of the absence of the petitioner, the Court was unable to proceed further. No reason was assigned, much less a valid reason, for his absence for about three years. The petitioner had not even chosen to take steps for getting his NBW cancelled by filing an appropriate application. If the petitioner is released on bail, he may not appear before the learned Trial Court and cooperate with the Trial. It is alleged that the petitioner was involved in dealing with 400 Kgs of ganja. 4.
Considering the facts and circumstances of the case, there are no merits to grant bail to the petitioner/Accused No.1. Hence, the Criminal Petition is liable to be dismissed. 5. In the result, the Criminal Petition is dismissed. _________________________ DR. Y. LAKSHMANA RAO, J Date: 27.10.2025 RSI
