Rakesh Kainthla, Judge The petitioners have filed the present petition for quashing of FIR No. 228 of 2018, dated 06.11.2018, registered at Police Station Amb, District Una, H.P. for the commission of offences punishable under Sections 498-A and 406 read with Section 34 of the Indian Penal Code (IPC) and the consequent proceedings arising out of the FIR based on the compromise effected between the parties. They filed a petition for mutual divorce before the Family Court at Amb. The marriage between them was dissolved, and it was agreed that they would withdraw the cases filed by them; hence, the petition. 2. The statement of the informant-Seema Rani, was recorded on 22.04.2025, in which she stated that the matter was reconciled with the petitioners without any influence, and she does not want to proceed further with the FIR lodged by her. 3. The FIR was lodged for the commission of offences punishable under Sections 498A and 406 read with Section 34 of the IPC. The offence punishable under Section 406 of the IPC is compoundable under Section 320 of the CrPC. An offence punishable under Section 498A of IPC can be quashed as per the judgments in Gian Singh versus State, 2012 (10) SCC 303, Narender versus State of Punjab, 2014 (16) SCC 466, Vikas Singh vs. State of H.P. (2023) I DMC 335 (HP) and Sanjay Kumar vs. State of H.P2023 (1) Him L.R. 602 based on the compromise, which are binding upon this Court. 4.
Consequently, the present petition is allowed and the FIR No. 228 of 2018, dated 06.11.2018, registered for the commission of offences punishable under Sections 498-A and
