The present applicant ‘Rajkumar Sagar @ Raju’ S/o Jagdish Sagar is languishing in jail since 11.01.2025 in relation to First Information Report dated 06.01.2025 bearing FIR No. 10 of 2025 P.S. Rudrapur, District Udham Singh Nagar, wherein, the present applicant along with two other Johnny and Sandeep Gupta and one unknown person were implicated for the offences punishable under Sections 125(a), 125(b), 3(5) and Section 105 of BNS, 2023. 4. Today, the counter affidavit has been filed and the same is placed on record. 5. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and furthermore in this particular case the charge sheet has already been filed and as such there is no need of custodial interrogation of the present applicant. 6. Apart from this, he submits that this is a case of certain provocation and the deceased has been died due to brick stone, which was thrown by one another co accused Rohit and he submits that even the complainant in his statement disclosed the name of Rohit. 7. Apart from this, he submits that the applicant have no previous criminal history and that the other co-accused namely Sandeep Gupta has already been enlarged on bail by this Court today itself. 8. On the other side, learned State counsel have not disputed this fact that the other co-accused Sandeep Gupta has already been enlarged on bail today itself and the main role has been assigned to Rohit and the charge sheet has been filed. 9. After hearing learned counsel for the parties and further taking into consideration that the charge sheet has been filed and there is no need of custodial interrogation of the present applicant and 2025:UHC:4196 furthermore the applicant have no previous criminal history, this court is of the view that the applicant deserves for bail. 10. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 11. Let the applicant ‘Rajkumar Sagar @ Raju be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
