No.24432 of 2025, whereby the learned single Judge has directed the University - appellant herein to permit the petitioner Institution to participate in the A.P. LAWCET counseling for the academic 2025-26. year f HCJ aCGR,‘J W.A. Nos: 1120 of 2025 2. It is stated by the learned Advocate General appearing for the University that the direction is unsustainable in law inasmuch as the petitioner Institution has not been affiliated with the University much less has any inspection been conducted in regard to the said institution. Apart from this, it i: stated that the Bar Council of India approval has not been obtained for the relevant academic year 2025-26. IS 3. Learned counsel for the writ petitioner, on the other hand, would submit that the approval by the Bar Council of India could be obtained only after the University grants affiliation to the petitioner Institution. It is also stated that the petitioner Institution had since deposited the requisite amount of Rs.88,500/- with the University and therefore, there was no bar for the University to conduct an inspection for purposes of formally granting affiliation to the petitioner Institution i.e., K.M.R. Law College. 4. Although learned Advocate General would submit that the petitioner had failed to apply for affiliation for the session 2025-26 within the time prescribed where the cut-off date was 10.07.2025 and that the actual date of payment of the requisite fee by the Institution was 25.07.2025, it is stated by Mr. N. Subba Rao, learned Senior Counsel appearing for the Institution that the payment made on 25.07.2025 was pursuant to the extension granted by the University for purposes of depositing the said amount. I 5. Be that as it may, since the amount has already been received by the University, we do not see any impediment to the University conducting an f 3 HCJ a CGR, J W.A. Nos:1120 of 2025 inspection of the petitioner Institution for granting affiliation to the petitioner Institution, appellant assures us that the inspection would be orders would be passed on the application seeking affiliation purposes of either refusing Learned counsel for the or conducted and appropriate within a period of ten days from today. In case the University proceeds to grant affiliation petitioner would be under , the an obligation to seek formal approval of the affiiiation from the Bar Councii of india in terms of the rules of the Bar Council of India Legal Education Rules, 2008. 6. In our opinion, the direction issued by the learned single Judge to permit the petitioner Institution to participate in the A.P. LAWCET counseling for the academic year 2025-26, without any affiliation for the session 2025-26 or the formai approvai of the affiliation from the Bar Council of India is unsustainabie in law. We, therefore, set aside the impugned order and direct the University to conduct the inspection and pass appropriate orders, as assured by the learned Advocate General, within Appeal is, accordingly, disposed of.
