Mardum, Tahsil Lohandiguda, District Bastar Chhattisgarh ... Applicant versus 1 - State Of Chhattisgarh Through Station House Officer, Police Station Mardum (Police Chowki- Kaknar), District Bastar Chhattisgarh ... Respondent(s) For Applicant : Mr. Ashok Kumar Komra, Advocate For Respondent(s) : Mrs. Pragya Shrivastava, Dy. G.A. Hon’ble Shri Justice Arvind Kumar Verma, Judge Order on Board 05/02/2025 1. The applicants have preferred this First Bail Application under Section 483 of BNS, 2023 for grant of regular bail, as they have been arrested in connection with Crime No. 20/2024, registered at Police Station Mardum, District- Bastar (CG) for the offence 2 punishable under Section 302, 201, 34 and 109 of IPC. 2. The prosecution story in brief is that the complainant/informant of the merg intimation has lodged report to concerned police station that at the time of incident on 07.06.2024 the deceased was highly intoxicated and there was simple family dispute in between the deceased and his wife Ramali Kashyap (PW-1) and thereafter, after eating food, they slept in their room and the deceased has committed suicide by handing at this courtyard and the police has registered merg intimation no. 0/2024 and thereafter, during investigation, police has registered the offence punishable under Section 302, 201, 34 and 109 of IPC at Crime No. 20/2024 against present applicants. 3. It was argued by the learned counsel for the applicants that the applicants have been falsely implicated in this case. The applicants are in jail since 07.08.2024. Also, the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicants. 4. On the other hand, learned counsel for the State opposes the bail application and contended that the applicants are not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy this 3 Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail. Accordingly, the bail application of applicants- Purandhar @ Puran Mourya and Jagatu Mourya involved in Crime No. Crime No. 20/2024, registered at Police Station Mardum, District- Bastar (CG) for the offence punishable under Section 302, 201, 34 and 109 is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/- (Arvind Kumar Verma) JUDGE Madhurima
