ALL INDIA COUNCIL FOR TECHNICAL EDUCATION, REPRESENTING BY ITS MEMBER - SECRETARY NELSON MANDELA MARG, VASANTH KUNG, NEW DELHI - 110070 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay be pleased to issue an appropriate writ more in the nature of Writ of Mandamus declaring the impugned GO vide GO RT No. 130, Fligher Education (EC) Department dated 13-07-2025 issued by the 1st Respondent on the instance of 4th Respondent University, whereby and whereunder the Respondents reduced the intake capacity of the Petitioner-Institution to a tune of 30 seats in AI and DS (Artificial Intelligence And Data Science), 60 seats in CSE (Computer Science and Engineering) and 30 seats in ECE (Electronics and Communication Engineering) contrary to the allotment made by the 6th Respondent, Apex Body i.e. AlCTE and further the 5th Respondent basing on the impugned GO, disclosed the reduced strength on the v/eb portal for the academic year 2025- 26 in the ongoing APEAPCET-2025 counselling which commenced from 13.07.2025 as being arbitrary, illegal, unwarranted and violative of Articles 14 and 19(1)(g) of the Constitution of India against principles of natural justice and consequently set aside the same to the extent of the Petitioner institution and issue IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to suspend the impugned GO Vide GO RT No. 130 Higher Education (EC) Department, dated: 13-07-2025 to the extent of the Petitioner institution and to issue a revised order duly disclosing the actual intake capacity as granted by the Apex Body i.e. AlCTE vide orders dated: 03- 01- 2025, pending Writ Petition, in the interest of justice and pas IA NO: 2 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the Respondent Nos. 3 to 5 to disclose the intake capacity in the APEAPCET-2025 counselling through the web-portal for the academic year 2025-26, pending Writ Petition, in the interest of justice and pass IA NO: 3 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Pleased to direct the Respondent Nos. 4 and 5 University and convener to issue allotments to the students dully enhancing the intake capacity of the Petitioner institution as approved by the apex body (AlCTE) else the very purpose of passing the interim direction would be frustrated and the Petitioner-Institution would stand to suffer irreparable loss and injury pending Writ Petition, in the interest of justice and pass Counsel for the Petitioner: 1. K RADHIKA The Court made the following ORDER: The present Writ Petition has been filed, under Article 226 of the Constitution of India, seeking the following relief:- “…to issue an appropriate Writ more in the nature of Writ of Mandamus declaring the impugned GO vide GO RT No.130. Higher Education (EC) Department, dated 13.07.2025 issued by the 1st Respondent on the instance of 4th Respondent University whereby and whereunder the Respondents reduced the intake capacity of the Petitioner-Institution to a tune of 30 seats in AI & DS (Artificial Intelligence And Data Science), 60 seats in CSE (Computer Science and Engineering) and 30 seats in ECE (Electronics and Communication Engineering) contrary to the allotment made by the 6th Respondent, Apex Body i.e., AlCTE and further the 5th Respondent basing on the impugned GO, disclosed the reduced strength on the web portal for the academic year 2025-26 in the ongoing APEAPCET-2025 counselling which commenced from 13.07.2025 as being arbitrary illegal unwarranted and violative of Articles 14 and 19(1)(g) of the Constitution of India against principles of natural justice and consequently set aside the same to the extent of the Petitioner institution.” 2. Today, when the matter came up for hearing, learned counsel for the petitioner submits that, in view of the interim orders passed by this Court in IA No.3 of 2025 in WP No.17790 of 2025, dated 22.07.2025, no further orders are necessary to be passed in this Writ Petition. 3. Recording the said submission, the Writ Petition is closed. There shall be no order as to costs.
