The Court made the following: 3 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CIVIL REVISION PETITION NO: 2808/2025 ORDER:- The Civil Revision Petition is filed under Article 227 of the Constitution of India declaring the inaction of the learned Principal Junior Civil Judge, Kadapa in disposing of E.P.No.387 of 2023 in O.S.No.1011 of 2021 which was filed under Order 21 Rule 11(2) and 34 of C.P.C. 2. Heard learned counsel for the petitioners. As issuance of notices to the respondents is not necessary in this matter, hence notices to the respondents are hereby dispensed with. Perused the material on record. 3. On hearing, learned counsel for the petitioners submits that the petitioners herein filed E.P.No.387 of 2023 in O.S.No.1011 of 2021 before the Court of Principal Junior Civil Judge, Kadapa (for short “the trial Court”) seeking to issue notice to the 1st respondent/Judgment Debtor/Defendant under order 21 Rule 34 of C.P.C. by directing the 1st respondent/Judgment debtor/defendant to execute the regular registered sale deed in favour of the petitioners/Decree Holders/Plaintiffs and if the 1st respondent/Judgment Debtor fails to execute regular registered sale deed in favour of the petitioners/Decree Holders regarding E.P. Schedule property, the trial Court may be pleased to permit the petitioners/Decree holders to obtain the same through process of law from the trial Court in respect of the E.P. Schedule mentioned property in the interest of justice. The learned counsel further submits that though the petition is pending before the trial Court for a 4 substantial period of approximately two (02) years, the trial Court has kept the petition pending and is not disposing of the petition for one reason or the other. Hence, the learned counsel requests this Court to issue an appropriate direction to the trial Court for speedy disposal of the said E.P. 4. Considering the submissions of the learned counsel for the petitioners, the learned Principal Junior Civil Judge, Kadapa is directed to dispose of E.P.No.387 of 2023 in O.S.No.1011 of 2021, as expeditiously as possible, preferably within a period of three (03) months from the date of receipt of a copy of this order. 5. With the above directions, this Civil Revision Petition is disposed of at the stage of admission. There shall be no order as to costs.
