Social Security Pension to the petitioner with pension card No. 102437341 since August, 2021 to till date without conducting enquiry, violating the principles of Natural Justice and in violation of Art 14 and 21 of Constitution of India and consequently direct the respondents to release the old aged pension from August, 2021 and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to grant interim orders directing the respondents 3 and 6 to pay monthly old aged pension to the petitioner and to release arrears of old aged pension from August, 2021 forthwith to the petitioner pending disposal of above writ petition and pass Counsel for the Petitioner:

ORDER:-
This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“ to issue a writ, order or direction more particularly one in the nature of Mandamus declaring the action of the respondents 2 to 6 in not paying old aged pension i.e., Social Security Pension to the petitioner with pension card No.102437341 since August, 2021 to till date without conducting enquiry violating the principles of Natural Justice and in violation of Art 14 and 21 of Constitution of India and consequently direct the respondents to release the old aged pension from August, 2021 and pass such other order or orders...”
2. Heard learned counsel for petitioner, learned Government Pleader for Panchayat Raj and Rural Development for respondent Nos. 1 to 4, Sri Y.Koteswara Rao, learned Standing Counsel for Gram Panchayat respondent Nos. 5 and Sri M.Hari Babu, learned Standing Counsel for SERP for respondent No.6.

Learned counsel for the petitioner submits that the petitioner herein was born on 01.01.1963 and aged about 62 years as of now as per the Aadhar Card. As such, the petitioner is entitle and eligible to receive old aged pension i.e., Social Security Pension in terms of G.O.Ms.No.174, Panchayat Raj & Rural Development dated 13.12.2019. He further submits that the petitioner herein submitted number of requests for granting old age social security pension. But for one reason or the other, the respondents did not consider the request of the petitioner so far and not granted the pension. Finally, the petitioner submitted a

representation under PGRS redressal programme. But so far, the petitioner was not included as beneficiary under old aged social security pension programme. Aggrieved by the same, the petitioner herein filed the present writ petition. 4. On the other hand, learned Standing Counsel for respondents submits that the petitioner keep on making applications/ representations seeking for grant of old age pension under the social security pension scheme without attaining age of 60 years. He further submits that prime criteria as per the terms of G.O.Ms.No.174 dated 13.12.2019, that a person who attains the age of 60 years is eligible to receive old aged social security pension. In the instant case, the petitioner had submitted representations/ complaints under PGRS programme in the year 2021, much before attaining age of 60 years. As such, the petitioner is not entitled to receive pension in the year 2021. But today, since the petitioner attained the age of 60 years, his candidature/ representation if any would be considered for sanction of old aged pension under the social security pension scheme in terms of G.O.Ms.No.174, dated 13.12.2019. 5. Learned Standing Counsel for the respondent No.4 furnished written instructions submitted by respondent No.4, which also confirms the eligibility and entitlement of the petitioner to receive old aged social security pension since he attains the age of more than 60 years. 6. Considering the submissions made by the learned counsel for the petitioner, learned Standing Counsel for respondents and on perusal of the material placed on record, it appears that as of now the petitioner herein is eligible and entitled to receive old aged social security pension since he attained more

than 60 years of age and also eligible in all other respects in terms of G.O.Ms.No.174 dated 13.12.2019. 7.
Therefore, this Court is of the considered view that the present writ petition can be disposed of, directing the respondent Nos. 4 to 6 to consider the candidature of the petitioner in terms of G.O.Ms.No.174 dated 13.12.2019 and to grant old aged pension under the social security pension scheme, along with all other new applications whenever the Government is proposes to sanction the old aged pension, as early as possible, more particularly, not later that a period of two (02) months from the date of receipt of a copy of this order. 8. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
