Neutral Citation No. - 2025:AHC:93381 Reserved on 27.05.2025 Delivery on 30.05.2025 Court No. - 33 Case :- WRIT - C No. - 16991 of 2025 Petitioner :- M/S Qamar Ziya Respondent :- State Of Uttar Pradesh And Another Counsel for Petitioner :- Satyawan Shahi Counsel for Respondent :- C.S.C. Hon'ble Prakash Padia,J.
1. The fair price shop licensee of the petitioner was cancelled vide order dated 05.01.2019 passed by the respondent no.3-District Supply Officer, Meerut. 2.Aggrieved against the aforesaid, petitioner has preferred Writ-C No. 21748 of 2019 which is pending consideration before this Court.
3. It is argued by the learned counsel for the petitioner that fair price shop licence of the petitioner was cancelled on account of the fact that criminal Case No. 1371 of 2018, under Section 3/7 of Essential Commodities Act read with section 66C of Information and Technology Act and Section 420 I.P.C. was registered against the petitioner. It is further argued that aforesaid question has already been decided by Co- ordinate Bench of this Court vide order dated 11.09.2024 in Writ-C No. 19800 of 2019, which has attained finality upto Hon'ble Apex Court, copy of judgment dated 11.09.2024 is appended as Annexure No.5 in Writ-C No. 16991 of 2025.
4. It is argued by the learned counsel for the petitioner that taking advantage of pendency of the writ petition filed by the petitioner before this Court, now fresh notification dated 22.04.2025 has been issued by
the respondent no.2-District Supply Officer, District Meerut in which the name and location as contains at serial no.3. It is further argued that against the order dated 22.04.2025 present writ petition has been filed and since in the identical facts and circumstances of the case, other writ petitions have already been allowed hence notification is liable to be set aside.
5. In the earlier writ petition filed by the petiioner being Writ-C No. 21748 of 2019 judgment has already been reserved.
