The instant writ petition under Article 226 of Constitution of India is filed seeking the following main prayer:-
“…..declaring the action of the respondents in not considering the case of 2nd the petitioner for Appointment on compassionate grounds for any suitable post, as high handed and arbitrary action and as such liable to be set aside in the interest of justice with a consequential direction to the respondents to appoint the petitioner as Shramik or in any suitable post on refund of the Additional Monetary Benefit and pass…….”
2. When the matter is called, Sri Aravala Rama Rao, learned Standing Counsel for APSRTC referring to the averments made in the counter affidavit filed by the respondents, submits that the 1st petitioner, who is wife of the deceased received the refund of the Additional Monetary Benefit (AMBF) through cheque by the respondent authorities as she does not possess educational qualifications for compassionate appointment. He further submits that once the AMBF amount was paid to the 1st petitioner (wife of the deceased), compassionate appointment cannot be claimed by the 1st petitioner nor the 2nd petitioner (son of the deceased), even they are ready to return the AMBF amount. 3
3. The learned counsel for the petitioners has not disputed the above said
submissions.
4. Having regard to the submissions made that the petitioners have received AMBF amount, the writ petition is closed. There shall be no
order as to costs. As a sequel, all pending applications shall stand closed.
