MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 17.10.2025
01.
1. Heard learned counsel for the respective parties.
2. Instant writ petition is filed by the petitioner for a direction to the opposite parties with regard to recovery of an amount of Rs.4.35 lac from opposite party No.7 for non- execution of a project under the concerned G.P. as it has been misappropriated and for taking criminal action against him.
3. It is pleaded by the petitioner that there has been misappropriation of fund by opposite party No.7 which is to be recovered from him with such other action taken by opposite party No.2 and in that connection, representation has been pending orders before the said authority and therefore, necessary direction may perhaps be issued in that regard. Referring to a copy of the estimated cost and payment orders, it
is claimed that the amount has been misappropriated by opposite party No.7, hence, the enquiry is necessary.

5. Since the petitioner claims to be a Trustee of the establishment and he has approached the authority concerned with a representation i.e. Annexure-2 series, recording the response of Mr. Ray, learned AGA for the State, the Court is of the view that opposite party No.2 should be directed to examine it with a decision at the earliest provided he has a locus standi to question opposite party No.7.
6. Accordingly, it is ordered.
7. In the result, the writ petition stands disposed of with the direction as aforesaid to be complied with by opposite party No.2 in relation to Annexure-2 series and to take a decision thereon as soon as possible preferably within a period of three weeks from the date of receipt of a copy of this order.
