Das, ASC COROM: JUSTICE BIRAJA PRASANNA SATAPATHY Order No ORDER 23.09.2025 01. 1. This matter is taken up through Hybrid Mode. 2. Heard learned counsel for appearing for the Parties. 3. The present Writ Petition has been filed inter alia with the following prayer:- “It is therefore, humbly prayed to this Hon'ble Court may graciously be pleased to:- 1) direct the opp. parties to sanction the grade pay of Rs.4200/-under MACP scheme towards 1" financial up gradation on completion of 10 years of service as VLW w.e.f. 05.06.2019 In view of the Judgment of this Hon'ble Court in W.P.(C) No.2831/2016; State of Odisha vrs. Biharilal Barik, which has been affirmed by the Hon'ble Supreme court in SLP(c) Diary No. 20358/2017, decided vide order dt. 23.8.2017 and thereby fix his pay and sanction pension taking into consideration his initial appointment 01.10.1989 along with his regular service as VLW for more than 14 years on being duly promoted to such post by the Collector-cum- District Magistrate, Dhenkanal vide order dated 05.06.2009 in view of the principles decided by this Hon'ble court in W.P. (C)No. 6267/2018, which has been affirmed by the Apex court in SLP(C)No. 28065/2019, decided on 18.05.2022 within a stipulated period as may be fixed by this Hon'ble court; ii). Pass such other order (s)/direction(s) as would be deem fit and proper in the bona fide interest of Justice; And for which act of kindness, the petitioner as in duty bound shall ever pray”. 4. In course of hearing, learned counsel for the Petitioner states that highlighting his grievances, the Petitioner has made a representation to Opposite Party No.3 vide Annexure-10 and the same may be directed to be considered within a stipulated time, to which learned Counsel for the State has no objection. 5. As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.3 to consider the representation filed by the petitioner vide Annexure-10 within a period of three (3) months in accordance with law from the date of production of certified copy of this order.
