The writ petition is filed challenging the proceedings dated 05.09.2019 of the 2nd respondent, dispensing with the services of the petitioner(s) with effect from 01.10.2019. It is contended that the said proceedings were issued without any notice and without assigning any reasons. 3. Pursuant to the scheme notified by the Central Government, viz., National Rural Drinking Water Programme (NRDWP), for providing safe drinking water to the rural population and for the implementation of the said programme at the village and remote areas, Mandal Resource Coordinators (MRCs) were appointed on a contract basis. The scheme was funded 50% by the Central Government and the remaining 50% by the respective State Governments. 4. Pursuant to the notification calling for applications from eligible candidates, the petitioners submitted their applications. The petitioners were selected for the post of Mandal Resource Coordinator, after following the due process, including an oral interview conducted by the 4th respondent. 20 5. The duties assigned to the said post include coordination for the development and improvement of sanitation services, water quality maintenance and surveillance, water samples tested in laboratories, etc., and coordination with the Village Gram Panchayats. 6. It is further contended that the pay attached to the post was ₹5,000 per month, which was subsequently enhanced to ₹13,000 per month. 7. It is contended that although the petitioners have discharged their duties without any complaint, the respondents, by the impugned proceedings, have proposed to remove the petitioners from service. 8. It is further contended that after the impugned proceedings, the 2nd respondent, vide Memo dated 26.09.2019, conveyed that the Managing Director, AP Swachh Andhra Corporation, had orally agreed to continue the services of the Mandal Resource Coordinators (MRCs) and to pay their remuneration from the available funds of the said Corporation. 9. In this regard, all the Superintending Engineers, RWS&S, were instructed to address the Managing Director, AP Swachh Andhra Corporation, for payment of remuneration to the MRCs with effect from 01.10.2019. Thereafter, vide proceedings dated 29.11.2019, the 2nd respondent directed that the services of the MRCs could be continued, and their remuneration would be met from the funds of AP Swach Andhra Corporation. 10. Despite the said proceedings, the respondents failed to cancel the impugned proceedings. Hence, the present writ petition has been filed. 21 11. The learned counsel for the petitioners places reliance on the above two proceedings dated 29.11.2019 and proceedings dated 25.09.2019 and also on the decision of the erstwhile composite High Court of Andhra Pradesh in W.P.No.1814 of 2014 and batch. 12. The 2nd respondent filed a counter affidavit stating that the decision of this Hon’ble Court relied upon by the petitioners in W.P.No.15055 of 2019 is distinguishable on facts, as in the light of the facts of this case the petitioners have approached this Court after the expiry of their contract period on 31.03.2019, whereas, in the said case, i.e, W.P.No.15055 of 2019, the petitioner(s) approached the court during subsistence of the contract period and thus the interim directions were granted to continue the petitioner therein, in service, until further orders. 13. It is further stated that in compliance of the directions issued by the 2nd respondent, not to continue the services of the petitioners after 30.09.2019, the impugned proceedings has been issued. 14. Learned Assistant Government Pleader for Services II placed reliance on the decision of the Hon’ble Apex Court in Delhi Development Horticulture Employees Union vs. Delhi Administration1, wherein it was held that when a scheme is temporary after the expiry of the said scheme, the petitioner(s) has no focus to continue in the service after the expiry of the period of the scheme. 1 (1992) 4 SCC 99 22 15. Considered the rival submissions. 16. A perusal of the impugned proceedings show that, although the services of the Mandal Resource Coordinators (MRCs) were directed to be dispensed with vide the impugned proceedings, the subsequent proceedings dated 26.09.2019 and 29.11.2019 the Superintending Engineers (RWS&S Department) were instructed, pursuant to the meetings held with the AP Swachh Andhra Corporation, to continue the services of the MRCs. The Superintending Engineers were also directed to address the Managing Director, AP Swachh Andhra Corporation, for the purpose of payment of remuneration to the MRCs from the funds available with the said Corporation. 17. Having regard to the above, it is evident that the counter affidavit filed by the respondents does not make any reference to these two proceedings i.e, dated 26.09.2019 and 29.11.2019. From the said proceedings it is clear that a conscious decision had been taken to continue the services of the MRCs, and that the expenditure towards their remuneration was directed to be met from the funds of AP Swachh Andhra Corporation. Therefore, the 2nd respondent ought to have issued proceedings for continuation of the services of the petitioners in accordance with the said proceedings. 18. In light of the proceedings dated 26.09.2019 and 29.11.2019 issued by the 2nd respondent and the judgment of this Hon’ble Court in W.P.No.1814 of 2014 & batch, the petitioners are entitled to continuation of their services. 23 19. Accordingly, the Writ Petitions are disposed of and the impugned order dated 05.09.2019 is set aside. There shall be no order as to costs.
