The present contempt petition has been filed for non-compliance and willful disobedience of the order dated 03.06.2025 passed by coordinate Bench of this Court in WPS No. 3973 of 2025. Learned counsel for the petitioner would submit that in the order dated 03.06.2025, the coordinate Bench of this Court has directed that initiation of the second Departmental Enquiry will be subject to final outcome of this petition and it is the authorities concerned who restricted to proceed with the Departmental Enquiry because only initiation of the second Departmental Enquiry was order to be subject to final outcome of the petition, the inquiry officer is proceeding with the matter and statements of the witnesses as well as delinquent employee has been recorded which is willful disobedience of the order dated 03.06.2025. 3. I have heard learned counsel for the petitioner and perused the material annexed with the petition. 4. The relevant part of the order dated 03.06.2025 passed in WPS No. 3973 of 2025 is reproduced as under: “Learned counsel for the petitioner submits that the Respondents Department has initiated second Departmental Enquiry against the Petitioner on the basis of earlier charge-sheet, therefore, the proceedings for initiation of second Departmental Enquiry may be stayed. In view of the above submission, it is ordered that initiation of the second Departmental Enquiry will be subject to final out come of this petition.” 5. From perusal of the order impugned, it transpires that the petitioner himself has submitted that the Department has initiated the second Departmental Enquiry against the petitioner and the coordinate Bench of this Court has passed the order that initiation of subsequent Departmental Enquiry will be subject to final outcome of this petition. It does not mean that the proceedings of the subsequent Departmental Enquiry was stayed by the order dated 03.06.2025 in absence of any restriction to proceed with the Departmental Enquiry, the authority can very well proceed with the 3 Departmental Enquiry and conclude the same of course the subsequent Departmental Enquiry would be subject to final outcome of the writ petition. 6. Therefore, I do no find and willful disobedience of the order dated 03.06.2025 passed in WPS No. 3973 of 2025. 7. Accordingly, the present contempt petition is dismissed.
