This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 have been filed by the applicants, who are apprehending their arrest in connection with Crime No.749/2025 registered at Police Station –Kotwali Distt-Korba (C.G.) GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.11.11 18:40:31 +0530 2 for the offences punishable under Sections 296, 351(3), 115(2), 309(6), 324(5), 3(5) of Bhartiya Nyay Sanhita 2023. 2. Case of the prosecution, in brief, is that on dated 13.10.2025 complainant Karan Deep Singh made a report before the police station Kotwali, Distt Korba (C.G.) that on 12.10.2025 a program of National level dancer was organized at Jashn Resort, Korba (C.G.). The said event was organized by Amit Navranglal, Anil Dwivedi and the present applicants. After conclusion of the program Sapna Chaudhary and her team members went to their rooms in the resort where Amit Navranglal, Anil Dwivedi and present applicants had arrived. It is alleged that Amit Navranglal, Anil Dwivedi and present applicants using the filthy and abusive language towards Sapna Chaudhary and her team, accused of them taking more money and created a nuisance in the reception of the resort. It is also alleged that they damaged the property of the resort during the incident and looted cash of Rs. 10,000/-, a Laptop and a DVR and thereby committed the above offence. 3. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated by the complainant. He would submit that no such incident has been taken place it is only a counter blast as Anil Dwivedi who is one of the co-accused in present crime number has made a written report against the complainant on the much prior at about 3:18AM on 13.10.2025. The said FIR has been registered as Crime No. 748/2025. He would submit that present accused are the organizer of the event if such incident has been taken place the complaint was registered from the side of Sapna Chaudhary 3 and her team and the present FIR has been registered only to make pressure upon the applicants to withdraw the earlier FIR against the complainant. He would submit that co-accused Anil Dwivedi has been granted anticipatory bail by this Court in MCRCA No.1699/2025 on 6/11/2025, therefore, he submits that the present applicants are entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail and she would submit that the applicant has three criminal antecedents which has been explained in para 4 of the bail application. 5. Learned counsel for the complainant also oppose the prayer for grant of anticipatory bail. 6. I have heard learned counsel for the parties and perused the material available on record. 7. Considering the facts & circumstances of the case, submission of learned counsel for the parties, material available on record, considering the nature of allegation levelled against the applicants, further the fact that co-accused Anil Dwivedi has been granted anticipatory bail by this Court in MCRCA No.1699/2025 on 6/11/2025 and also considering the fact that investigation and trial are likely to take some time, therefore, I am inclined to grant anticipatory bail to the present applicants. 8. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants – Yugal Sharma & Sujal Agrawal, on each of them executing a personal bond and one surety in the like sum 4 to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicants shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicants shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial. (d) The applicants and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
