This acquittal appeal has been preferred by the appellant/ State challenging the judgment dated 12.09.2017 passed by learned Special Judge (under the Prevention of Corruption Act), Balod, District Balod (CG) in Special Case No.07/2013 (State of C.G. vs. Gulab Chand Nahta), RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2025.11.20 13:22:39 +0530
2 whereby the respondent / accused has been acquitted of the charge under Section 7, 13(1)(d) read with Section 13 (2) of the Prevention of Corruption Act, 1988.
2. At the outset, learned counsel for the appellant /State informed the Court that the death report of the sole respondent /accused has been sent by the Sub-Inspector, ACB / EOW, Raipur (CG) along with a copy of death certificate of the respondent /accused Gulab Chand Nahta, wherein it has been mentioned that he has died on 16.01.2023.
3. Since the sole respondent /accused has died, therefore, this Acquittal Appeal stands disposed of as abated, as provided under Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
4. Record of the concerned Court below along with a copy of this order be sent back forthwith. Sd/-
