THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 10998/2025 ORDER:
The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the Petitioners/A-1 and A-2, seeking quashment of the proceedings pending against them in C.C.No.43 of 2025 on the file of Judicial Magistrate of First Class, Amadalavalasa, for the offences punishable under Sections 118(1), 115(2), 79 r/w 3(5) of BNS.
2. Heard Sri T.Diwakar Reddy, learned counsel for the petitioners and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.
3. As can be seen from the charge sheet, medical evidence is present in this matter. Wound certificates of three (3) persons are also placed on record. The matter requires enquiry at full length of trial, it is not a fit case for quashment.
4. In that view, this Criminal Petition is disposed of without causing any prejudice to the rights and contentions of the petitioners. However, the petitioners are at liberty to raise all their contentions before the Trial Court.
