1. This petition has been preferred by the petitioner under Article 226 of the Constitution of India seeking following reliefs:- 10.1 The Hon’ble Court may kindly be pleased to call for the entire records pertaining to this case from possession of the respondents for its kind perusal. 10.2 The Hon’ble Court may kindly be pleased to issue a writ/order/direction and quash/set-aside the
order dated 20.01.2025 (Annexure-P/1) issued by the respondent No.3 on behalf of the respondent No.2. 10.3 The Hon’ble Court may kindly be pleased to issue a suitable writ/order/direction, commanding the respondents to reinstate the petitioner in service with all consequential benefits. 10.4 Any other relief, which this Hon’ble Court may deem fit and proper, may also be passed in favour of the petitioner.
2. The petitioner was employed as a Work Charged Attendant Grade-III (Line) under the Chhattisgarh State Power Distribution Company Limited, which is an ‘industry’ as defined under Section 2(j) of the Industrial Disputes Act, 1947 (for short ‘ID Act, 1947’).
3. Considering the facts and circumstances of the case, this Court is of the opinion that the petitioner being a ‘workman’ within the meaning of Section 2(s) of the ID Act, 1947, the instant writ petition is, therefore, not maintainable before this Court. However, liberty is granted to the petitioner to raise an industrial dispute before the appropriate Government, i.e. Assistant Labour Commissioner (State), who shall consider the matter for conciliation. In the event if the conciliation fails, the Assistant Labour Commissioner (State) shall
3 refer the matter to the State Government, and if an industrial dispute exists, the State Government may refer the matter to the Labour Court for adjudication.
4. With the aforesaid observations and directions, this writ petition stands
