And 13 Others Counsel for Petitioner :- Ganesh Mani,Rahul Srivastava Counsel for Respondent :- Avneesh Tripathi,C.S.C.,Pratik Chandra,Rohan Gupta Hon'ble Manoj Kumar Gupta,J. Hon'ble Ram Manohar Narayan Mishra,J.
1. Heard Sri Ganesh Mani Tripathi, learned counsel for the petitioner, Sri Avneesh Tripathi for respondent nos. 2 and 5, Sri Rohan Gupta for respondent no. 6 and Sri Pratik Chandra for respondent no. 7. 2. The following prayers have been made in the writ petition: -
"i. A writ order or direction in the nature of mandamus directing the respondent no. 2 to 12 to take appropriate action against the respondent no. 13 & 14 for moving false applications against the institution. ii. A writ order or direction in the nature of mandamus directing the respondent no. 2 to punish the respondent no. 13 and 14 for moving illegal application and for tarnishing the image of college of institution. iii. A writ order or direction in the nature of mandamus directing the respondent no. 2 to 12 to consider and decide the application moved by petitioner on 14.06.2024."
3. The petitioner is alleged to be committee of management of an educational institution by the name of Indraprastha Law College. The case of the petitioner is that respondent nos. 13 and 14 are making repeated complaints against the petitioner which is tarnishing the image of the college. In the said backdrop, the petitioner has prayed for a direction to respondent nos. 2 to 12 to take action against respondent nos. 13 and 14. 4. On query made by the Court to learned counsel for the petitioner to show the provision of law under which respondent nos. 2 to 12 are obliged to take cognizance of the alleged action of respondent nos. 13 and 14 in making complaints against the petitioner, he is unable to show any provision of law to us. 5. In the facts and circumstances noted above, we find no good ground to issue any direction. It is always open to the petitioner to take action against respondent nos. 13 and 14, as may be permissible under any provision of law. 6. The petition is wholly misconceived and is dismissed.
