1. Heard Sri Chandresh Kumar Chaurasiya, learned counsel for the petitioner and Sri B.M.Shukla, learned Standing Counsel.
2. Petitioner has approached this Court after about 21 years and to claim that he was entitled for the benefit of ACP 2004-2012, without raising such claim during his entire service period.
3. Learned counsel for the petitioner has placed reliance on a Government Order dated 23.12.2010 that petitioner is entitled for benefit of ACP.
4. Learned Standing Counsel refers paragraph 7 of Government
Order dated 23.12.2010, according to which an option was required to be submitted within 90 days of said notification, however, writ petition is silent on this issue as well as counsel for the petitioner has no instructions about it, whether any option was submitted by petitioner or not. 5.In the aforesaid circumstances, since the petitioner was happy and satisfied and has never claimed for benefit of ACP during his entire service period as well he has not submitted any option as required in terms of referred Government Order, therefore, belated claim i.e. after 21 years cannot be considered.
