CONCILIATION ORDER
This revision petition is filed by the petitioner against the judgment dated 02.12.2021 in Crl.A.No.2514/2019 passed by the LV Additional City Civil & Sessions Judge, Bengaluru and the order of conviction dated 06.11.2019 in C.C.No.1548/2019 passed by the IV ACMM, Bengaluru. The trial Court ordered payment of Rs.2,25,000/-. The
order of the trial Court came to be confirmed in criminal appeal.

2. The learned Counsel appearing for the petitioner, respondent and their respective parties are present. The parties are identified by their respective counsels.
3. A joint memo signed by the learned advocates appearing for the petitioner, respondent and their respective parties is filed. According to joint memo, the parties have agreed to settle the dispute for a sum of Rs.1,70,000/- in full and final settlement of the claim made in C.C.No.1548/2019. The said amount is paid by the petitioner to the respondent by way of demand draft No.854221 dated 25.04.2025.
4. In view of the above, it is submitted that the parties have settled the dispute and no sums are due.
5. In the light of the joint memo, judgment dated 02.12.2021 in Crl.A.No.2514/2019 passed by the LV Additional City Civil & Sessions Judge, Bengaluru and the

order of conviction dated 06.11.2019 in C.C.No.1548/2019 passed by the IV ACMM, Bengaluru, are set aside and modified to the extent agreed by the parties in the joint memo. The petitioner is acquitted of the offence punishable under Section 138 of N.I. Act.
6. In view of the above, the revision petition stands

The Petitioner and the Respondent respectfully submit as follows:
1. The Respondent/Complainant had filed C.C. No. 1548/2019 against the Petitioner / Accused, before the IV Additional Chief Metropolitan Magistrate, Bengaluru (SCCH-6), under Sections 138 and 142 of the Negotiable Instruments Act, 1881, alleging dishonor of a cheque for a sum of Rs.2,25,000/- (Rupees Two Lakhs Twenty-Five Thousand). 2. Upon trial, the trial court was pleased to pass an order by convicting the Petitioner / Accused under Sec.138 N.I. Act, by directing the Petitioner / Accused to pay fine of Rs.2,25,000/- and in default to undergo simple imprisonment of 3 months vide judgment dated: 06.11.2019 passed in C.C.No.1548/2019. 3. The Petitioner / Accused being aggrieved by the order of conviction passed in C.C.No.1548/2019 by the IV Additional Chief Metropolitan

Magistrate, Bengaluru (SCCH-6), preferred an appeal in Crl.A.No.2514/2019 before the learned LV Additional City Civil and Sessions Judge, Bengaluru (CCH-56). The said appeal came to be dismissed vide judgment dated 02.12.2021. 4. Thereafter, the Petitioner / Accused has come before this Hon'ble Court by filing the above revision petition, and during the pendency of the present petition, the matter was referred for settlement before the Lok Adalat scheduled on 24.04.2025. In the said proceedings, both parties have amicably resolved and settled their disputes. 5. As per the terms of the settlement, the Respondent has agreed to accept a sum of Rs.1,70,000/- (Rupees One Lakh Seventy Thousand only) in full and final settlement of the claim made in C.C. No. 1548/2019. 6. The Petitioner has accordingly issued Demand Draft bearing No. 854221, drawn in favour of Respondent / Complainant for a sum of Rs.1,70,000/- (Rupees One Lakh Seventy Thousand only) dated 25.04.2025, and the same is being submitted before this Hon'ble Court along with this Memo. 7.
In view of the above settlement, arrived between the parties herein above, the Respondent has no objection to set aside the conviction and sentence passed in C.C. No. 1548/2019, and the parties jointly pray that this Hon'ble Court may be pleased to:
