The applicant has preferred this First Bail Application under Section 483 of the BNSS in connection with Crime No. 179/2025, registered at Police Station – Civil Line Rampur, District Korba (C.G.) for the offence punishable under Sections 331(4), 305(a), 111 & 317(4) of the Bhartiya Nyaya Sanhita, 2023. 2. As per the prosecution story brief is that the complainant has lodged a report to the concerned police station, alleging that on VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.07.07 10:35:14 +0530 2 the date of incient, the one unknown persons have entered in the house by breaking lock and has committed theft of golden and silver from his house. Based upon such complaint made by the complainant the police has registered the case under Section 331(4), 305(a), 111 & 317(4) of BNS 2023 against the unknown persons and after the investigation, the police has arrested the present applicant on the memorandum statement. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submits that the applicant has neither entered in the house nor committed stolen of any article of the complainant’s house, and the prosecution has not collected the sufficient material from the possession of the applicant regarding theft of the said article and he is in jail since 11.04.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, the learned counsel for the State opposes the bail application. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, the nature and gravity of the offence, the material available in the case diary, and the fact that the applicant committed theft of jewellery and sold it to a co-accused person, and that the crime was organized by 3 them, therefore, this is not a fit case to grant regular bail to the applicant. 7. Therefore, the bail application filed by the applicant/accused – Nikhil Soni involved in Crime No. 179/2025, registered at Police Station – Civil Line Rampur, District Korba (C.G.) for the offence punishable under Sections 331(4), 305(A), 111 & 317(4) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8.
