IN THE HIGH COURT AT CALCUTTA Special Civil Jurisdiction (Contempt) ORIGINAL SIDE

ATUL KUMAR GOEL AND ORS.
BEFORE :
THE HON’BLE JUSTICE DEBANGSU BASAK
And THE HON’BLE JUSTICE MD. SHABBAR RASHIDI Date : 15th July, 2025. Appearance : Mr. Soumya Majumdar, Sr. Adv. Md. Zohaib Rauf, Adv. ...for the petitioner.
Mr. Joy Saha, Sr. Adv. Mr. S. M. Obaidullah, Adv. ...for the alleged contemnor.
The Court :- Petitioner alleges violation of the judgement and order dated August 08, 2024. The contempt petition is taken up for consideration on completion of affidavits. After hearing the respective learned Advocates for the parties it appears that, the claims of the petitioner before us boils down to four heads, namely, annual health check up for 2020-2024, entertainment allowance for the same period, fuel reimbursement again for the same period and telephone bill for the period from 2016-2024. Learned senior advocate appearing for the alleged contemnors submits that, claim for annual health check up would be reimbursed on submission of bills with regard thereto. In response, learned senior advocate

appearing for the petitioner submits that, bills were already submitted. In any event, fresh submission was made on July 08, 2025. In such circumstances, the contemnor will proceed to consider such bills, in accordance with law and pay such amount as are found due and payable on account of annual health check up for the period from 2020 – 2024. So far as, entertainment allowance and fuel reimbursement claims are concerned, we are of the view that since such allowance and reimbursement are coupled with discharge of official duties and since the petitioner was not discharging any official duties as he was under suspension at that material point of time, we do not find disallowance by the authorities unjustified. So far as, telephone bills are concerned we are informed that the same will be reimbursed in accordance with the rank and entitlement of the petitioner before us. It is expected that the reimbursements spoken of in this order are made within a fortnight from date. The other claims of the petitioner may be canvassed before the appropriate forum. All points raised by the parties with regard thereto are kept open. CC/93/2024 is disposed of without any order as to costs.
